URGENT LEGISLATIVE ALERT

Backyard Vehicle Restoration Jobs Under Siege Again In Illinois

A bill (H.B. 367) has been introduced in the Illinois House of Representatives by Rep. Jack Franks (jack@jackfranks.org) that would further restrict the ability of Illinois vehicle hobbyists from maintaining inoperable vehicles on private property. H.B. 367 would redefine “inoperable motor vehicles” to include vehicles incapable of being lawfully driven on state highways in full accordance with Illinois vehicle laws. The bill would also expand the definition of inoperable vehicles to include dismantled and unlicensed vehicles. Under current law, localities may authorize fines and disposal of inoperable vehicles on public and private property.

Contact House Executive Committee Members (List Below) Immediately To Request Their Opposition to H.B. 367

H.B. 367 would give local authorities an inordinate amount of power in determining the disposition of inoperable historic project cars.


H.B. 367 would make it virtually impossible for Illinois hobbyists to maintain inoperable collector vehicles on private property.


H.B. 367 demonstrates a clear disregard and lack of understanding of the vehicle hobby and the rights of hobbyists.


H.B. 367 makes no legal distinction between an owner using private property as a dumping ground and a vehicle enthusiast working to maintain, restore or construct a vehicle.

does anybody else agree that this would be like going into somebody's house and killing a sick dog, or telling them to get rid of that old radio that doesn't work but it was their great grandma's first radio?......BS, please write in!

Hmm.  Sucks to be in IL...  I highly doubt this would ever get passed.

Its highly unlikely that will pass. But who knows. I'm not sure what possessed this bill to be introduced, but I know there are some properties where I live that are ridden with non functional cars. Theres one near downtown here that has several vehicles in plain site with no fence around them or anything, theres snakes nesting in the cars and rusty metal that kids could get hurt on. It makes sense to deal with things like that. But this bill worded the way you are presenting is pretty ridiculous, even if it were passed, I see an appeals judge reversing it in the near future.

I dont see that getting passed.  But Im glad I dont live in Illinois, although its a matter of time before similar bills make it to every state.

it is unlikely that it would pass b/c it is so unclear...at my house right  now we have 6 out in the back yard, nothing unsafe tho, just parts cars, or vehicles that need a little tlc

It took ALOT for us to stop it last time, it will take alot again but we still have lobbists fighting for the first one.

So many towns/villages/counties already have laws of this nature.  Especially around me.  They aren't enforced at all unless a neighbor has a complaint about it, but they are already in place.  It is just that they will become more common and will start to be enforced.  The laws around me are worded such that if the vehicles are covered under either motor vehicle insurance or listed on your home owners policy, then they are fine.

With as cheap as some of those carports (glorified tents) are, why not just put the ones you are working on under one of them...  Even though I have a garage (lg 1 car), I want to get my wife's car and my other car under a roof so I will be buying a metal carport to put along side my garage.  Not only will it open up more parking for guests, but it will keep them protected and doesn't increase my property taxes, nor does it require a building permit.

LOL! Well the particular lot I'm referring to is right next to my step-grandmother's house. People dump their cars there, and the owner basically said he doesn't care (a vacant lot where a business burned down a number of years ago) Shes complained about it for years, I haven't been up that way in a while, so I don't know if they did it. I know our city has been on the rampage with Eminent Domain especially that part of town, so they may have already done something about it by now. I don't have a garage, nor do I have property to put one. But I'm still living with the 'rents.

well i will be sure to write in just to prove a point, being i live in Chicago, Illinois, i have to do my part. but i highly doubt that this bill will get passed, cause there are way to many people who go about collecting cars and restorring them, especially where i live. but thanks for the heads up
