So heres another great drama in my life,My friend that has the Firebird got in the middle of battling dealerships. He took in his 99 Grand Am SE bout 3 months ago to trade for the 01 Firebird Convert. he has now..Well it seems 1 dealership is battling the other over some kinda bad trade in (down,payment etc,) No sure the whole story.anyways the 2 dealerships and my friend are going to court over this issue.I told my friend to beware that the 1 dealership might come Repo the Bird even though he is upto date on his payments and he thinks they wont, he calls it a revenge repo and he wont owe on his firebird if they take it and auction it off.I told him they can and will consider it a repo no matter what and he will owe on whats left of his loan after auction..anyone know bout this? am i right? or what..

wow that sucks. doesnt make sense y the two dealerships r in debate tho. i dont really know much about repos. watched a couple shows tho where the repo man came around lol but in my opinion legally as long as he's up to date on his payments they cant repo him

That Sucks. I can't give an opinion without a lot more info. It must be not good if the courts are needed to settle the situation.

Well heres a lil more i found out, when he traded the Grand Am for the Bird (KC motors owns title on GA) Dougs lot had the Bird..Dougs said they would trade,then after the deal was wrote up and my friend had the Bird for almost a month Dougs said they couldnt take the GA cuz KC Motors wouldnt let them have the title.so Dougs called my friend and said he needed to take the GA back.He didnt and Dougs sold it at Auction and thats where i got lost lol..so he still owes on GA after Auction and Still owes ALOT on the Bird and its going to court.So he is looking at 1 repo gone bad and i'm afraid Dougs will Repo the Bird..I know he is upto date on his payment but i feel 'Dirty deeds done dirt cheap' comingAnd i think there will be a mess including his Bird getting repo'd but he thinks if they 'Revenge Repo' he wont have to pay..Anyone know what im talkin about here?? lol

Yea he shouldn't have gotten rid of the Grand Am if he knew the trade wasn't going to go through. If he had any prior knowledge, the courts going to say he obtained the property under false pretenses and repo the firebird.
If he still owed on the Grand Am, why did he auction it..or did he sell it at the auction for less than he owed? I'd be more worried about something else getting repo-ed, or them making a claim on my house/equity because he no longer has the grand am.

I can't tell from the story if your friend knew something he should have told, or if the dealerships are screwing him.

Why would you trade a vehicle in to one dealership on a vehicle owned by a completely different dealership? That is just asking for problems.

If the dealership that he traded in the GA too auctioned it off allready then its on them to make the deal stick and work. They messed up and made the mistake of auctioning a car they had no title for and therefore if they go back on the trade in deal they need to recover his GA and give it back to him if they take back the firebird and then on top of that reimburse him the money spent on the firebird since the deal didn't get properly completed and reversed!!

I maybe wrong but this is what I get from this. That this guy was buying the GA from KC Motors on a buy here pay here deal. Well, the trade would of been OK had the GA been paid for but it wasn't. Doug's wasn't going to pay it off. So when Dougs called this guy basically the deal was off. Meaning he would have to pay off the GA before the deal was good. Why it took a month to figure this out I have no idea. Anyway Doug's was stuck with a GA & no title so they auctioned it off to get their money out of the Bird. Again I maybe wrong & hope I am but your buddy is SCREWED. He will have to pay for both cars at least. I guess from what I'm hearing is he wasn't straight up with the deal. If you trade off a car you owe money on the dealer has to pay it off, but my guess is they thought it was paid off & he just hadn't got the title yet.
Car dealers are shady but not stupid.
