I just put a K&N cone air filter on my stock intake an since the intake is no longer attached to the air box the filter kind of flops around not much but is just resting there.  My question is if this is a problem?  Thanks.

Since you have done more harm than good by sucking in hot engine bay air, I would definitely say that you need to do something to contain the filter.  You need to isolate it from the air that is passing through the radiator, getting hot from both that air and radiant heat from the engine.
